Section 3(1) of the Defamation Act 1952 was enacted to make it easier for claimants to recover damages in malicious falsehood by introducing a presumption of financial loss (in certain circumstances). Yet the Supreme Court in George v Cannell has held that in order to recover damages for injury to feelings under s3(1), a claimant must prove they have in fact suffered financial loss.
